General Conditions of Sale

These general terms and conditions of sale (known as “GTC”) govern the relationships between sellers and buyers on the DavLite platform, published by Saydav. They apply to all orders placed on the site https://www.davlite.com

1. Conclusion of the contract

Any order for products implies unreserved acceptance of these general terms and conditions of sale, supplemented or amended by our specific conditions. These general terms and conditions cancel any contrary clause that may appear in the conditions of purchase, order forms or other commercial documents.

2. Price

Goods are invoiced at the rate in effect on the day the order is placed. Payment can be made using one of the payment methods available on the platform, upon home delivery (the parcel’s destination), upon collection of the parcel directly from the seller’s store, or at one of our checkpoints  (agencies authorized for parcel collection).

The general price list is attached to these conditions. Product prices are set by the sellers and may be revised subject to 30 days ‘ prior notice .

3. Delivery

Delivery is carried out by :

– Direct delivery of the product to the purchaser.
– Making the product available at a designated location.
– Delivery to a shipper or carrier at the seller’s premises or any other agreed location.

Checking the goods  :

The buyer must check the goods upon receipt. In the event of damage, shortage, apparent defects, or non-conformity of the delivered product, the buyer must issue clear and precise reservations within 5 days  of the delivery date. These reservations must be notified in writing (via the return request form on the platform) to the seller or the sales team. The buyer must provide any justification as to the reality of the anomalies noted.

4. Delivery times

Delivery times are indicated based on supply availability.

In the event of a delay in delivery lasting more than 5 days  after the indicative delivery date (except in cases of force majeure: war, riot, fire, strike, etc.), the buyer will have the option of canceling his order, without being able to claim any compensation whatsoever.

5. Returns

All product returns must be formally agreed upon between the seller and the buyer. Return conditions will be defined according to the seller’s policy and applicable legal provisions.

6. Warranty

The seller will take the greatest care in the execution of the order and in the quality of the products. In the event of a defect recognized by the seller, the latter’s obligation will be limited to the replacement or reimbursement of the defective quantities, without any other compensation.

The following are excluded from the warranty:
– Defects and damage resulting from storage, handling, transport or use in abnormal conditions.
– Defects not in accordance with the nature, specifications or suitability for use of the product.

7. Payment

Payment by customers can be made :

– Via one of the payment methods available on the platform.
– Upon delivery of the package.
– Directly from the seller when collecting the package in store.

Withdrawal request for sellers  :

To request payment, sellers must submit a withdrawal request directly from their supplier dashboard. It is imperative to specify a preferred withdrawal method in the payment settings via the dashboard.

Withdrawal conditions  :

– All withdrawal requests must be greater than 2,000 XOF  (or the equivalent in the country’s currency).
– Invoices are payable within 24 to 72 hours  depending on the chosen withdrawal method.
– In the event of late payment, the seller may suspend all current orders.

Platform fees  :

For the seller-customer connection, sponsorship and maintenance of the platform, 10% will be taken  from each item sold.

No deposit or discount  is accepted for early payment.

8. Termination clause

In the event of non-payment, 72 hours  after a formal notice has remained unsuccessful, the sale will be automatically terminated by the seller. The latter may request the return of the products in summary proceedings, without prejudice to any other damages. The remaining amounts due for other deliveries will become immediately payable if the seller does not opt ​​to cancel the corresponding orders.

9. Retention of title

The goods sold remain the property of the seller until full payment of their price. However, the risks relating to the goods will be transferred to the buyer or the carrier upon physical delivery of the products.

10. Attribution of jurisdiction

These terms and conditions cancel and replace the previously applicable terms and conditions. Any dispute relating to these terms and conditions will be subject to the jurisdiction of the mixed commercial court of the seller’s geolocation (according to the establishment of the seller’s commercial register) or of the country where Saydav is established .

Legal information

These terms and conditions apply only to the DavLite platform, unless otherwise stated herein. In their dashboard, the seller has the option to customize their own terms and conditions, which apply only to their store and their items.
